This website is operated by Pierce Motorcycles Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Pierce Motorcycles. By accessing this website and/or purchasing from us, you agree to be bound by these Terms of Service.

If you do not agree to all of these terms and conditions, you must not use this website or our services.

Online Store Terms

By using this site, you confirm that you are at least 18 years old or have permission from a parent or guardian.

You agree not to use our products for any unlawful purpose or in breach of any New Zealand laws. You must not transmit malicious code, attempt to interfere with website security, or misuse the site in any way.

We reserve the right to refuse service to anyone at any time for any reason.

Products and Services

We sell motorcycle parts, accessories, and apparel within New Zealand.

We take reasonable care to ensure product descriptions, specifications, compatibility information, and pricing are accurate. However:

- Fitment and compatibility are the responsibility of the customer unless expressly confirmed by us in writing.
- Product images are for illustration purposes only and may vary slightly.
- Manufacturers may change specifications without notice.

We reserve the right to modify or discontinue products at any time without notice.

Pricing and Payment

All prices are in New Zealand Dollars (NZD) and include GST unless stated otherwise.

We reserve the right to change pricing at any time and to correct pricing errors. If a pricing error occurs, we may cancel the order and refund any payment made.

Orders may be cancelled if payment is declined or suspected to be fraudulent.

Shipping and Delivery

Delivery timeframes are estimates only and are not guaranteed.

We are not responsible for delays caused by courier services or events outside our reasonable control.

Risk of loss or damage passes to you upon delivery to the address provided at checkout.

Consumer Guarantees Act

Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 where those rights cannot be excluded by law.

If goods supplied to you are faulty, you are entitled to remedies under New Zealand law. Please refer to our Returns & Refunds Policy for further information.

If you are purchasing goods for personal, domestic, or household use, the Consumer Guarantees Act 1993 applies.

Trade and Business Purchases

If you are purchasing goods for the purposes of a business (including trade customers, workshops, mechanics, resellers, or commercial operators), then the Consumer Guarantees Act 1993 will not apply to the supply of those goods.

By purchasing goods for business purposes, you agree that:

- The goods are being supplied and acquired in trade;
- Section 43 of the Consumer Guarantees Act 1993 permits parties to contract out of the Act for business-to-business transactions; and
- It is fair and reasonable for the parties to contract out of the Consumer Guarantees Act to the fullest extent permitted by law.

If you are unsure whether your purchase is considered a business purchase, you must contact us prior to ordering.

Installation and Use of Parts

Motorcycle parts must be installed correctly and used appropriately.

We are not liable for damage or loss arising from:
- Incorrect installation
- Improper use
- Racing or competition use (unless the product is explicitly sold for that purpose)
- Modifications made after purchase

We strongly recommend professional installation for mechanical and electrical components.

Customers are responsible for ensuring products comply with applicable New Zealand road laws and safety requirements.

Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the purchase price of the goods supplied.

We are not liable for indirect, incidental, or consequential loss or damage arising from the use of our products.

Nothing in these Terms excludes liability that cannot be excluded under New Zealand law.

Intellectual Property

All website content, including logos, images, text, and branding, is the property of Pierce Motorcycles and may not be reproduced without written permission.

Privacy

Your personal information is handled in accordance with our Privacy Policy.

Governing Law

These Terms of Service are governed by the laws of New Zealand. Any disputes shall be subject to the jurisdiction of the New Zealand courts.
